General Conditions of Use

CITALID CYBERSÉCURITÉ, a simplified joint stock company with capital of 21,048 euros, whose head office is located at 72 rue Dulong – 75017 Paris, SIREN No. 833 926 264, is an IT publisher whose main activity consists of providing a service for the prevention of computer attacks via an advanced cyber risk management platform. CITALID CYBERSÉCURITÉ publishes a website accessible at www.citalid.com (hereinafter referred to as the “Site”). The purpose of these general conditions of use is to define the terms and conditions under which CITALID CYBERSÉCURITÉ makes the Site available to its Users. Any use of the Site by the User implies consultation, understanding and acceptance of these general conditions of use.

Definitions

GCU : The present general conditions of use. Users : The natural and legal persons who browse the Site and who have accepted the present general conditions of use. Information : The information and/or documents appearing on and/or accessible via the Site.

Scope of application

The purpose of the Site is to provide Users with information about CITALID CYBERSÉCURITÉ, its products and services.

Site access

The Site is accessible to all Users. Use of the Site is optional and free of charge. Any costs incurred by the User in accessing the Site shall be borne exclusively by the User. Users of the Site acknowledge that they have checked that the computer configuration they are using is virus-free and in perfect working order. CITALID CYBERSÉCURITÉ reminds all Users that the secrecy of correspondence is not guaranteed on the Internet and that it is the responsibility of each Internet User to take all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet. CITALID CYBERSÉCURITÉ cannot be held responsible for any damage, direct or indirect, that may result from accessing, using or downloading content via the Site, in particular, damage or viruses that may infect the User’s computer or any other equipment.

Contents

The Information has been obtained from sources believed to be reliable. The Information may be modified at any time and may be updated. In particular, they may have been updated between the time they were downloaded and the time the User takes cognizance of them. The use of the information available on the Site is the sole responsibility of the User, who assumes all consequences that may arise, without CITALID CYBERSÉCURITÉ being held liable. CITALID CYBERSÉCURITÉ shall in no event be held liable for any damages whatsoever resulting from the interpretation or use of the information and/or documents available on the Site.

Intellectual Property

The Site as a whole, as well as each of its component parts, in particular its content, data, texts and images, trademarks, whether figurative or not, and more generally any other distinctive sign appearing on the Site, are and remain the exclusive property of CITALID CYBERSÉCURITÉ or have been licensed to the latter and are legally protected by intellectual property rights (copyrights, databases, software, trademarks, etc.). Subject to compliance with these GCU, CITALID CYBERSÉCURITÉ grants the User a personal, non-exclusive and non-transferable right to access and use the Site. Any reproduction, representation or adaptation, in whole or in part, of the Site or its contents by any person or entity, by any process whatsoever, without the express authorization of CITALID CYBERSÉCURITÉ is prohibited and constitutes an act of infringement punishable by articles L. 335-2 et seq. of the French Intellectual Property Code. Any reuse or extraction, in whole or in part, of the Site’s databases by any individual or legal entity, by any process whatsoever, is prohibited and constitutes an act of counterfeiting punishable by articles L. 343-1 et seq. of the French Intellectual Property Code. Any total or partial reproduction of the trademarks and logos of CITALID CYBERSÉCURITÉ without its express authorization is prohibited pursuant to Articles L. 713-2 et seq. of the French Intellectual Property Code. All other distinctive signs of CITALID CYBERSÉCURITÉ or its clients available on the Site and reproduced without express authorization is likely to constitute usurpation engaging the responsibility of its author on the basis of article 1240 of the Civil Code.

Hypertext links

It is forbidden to create a hypertext link to the site or to elements of the site without the express prior written authorization of CITALID CYBERSÉCURITÉ. Requests for authorization must be sent in writing to communication@citalid.com. Authorizations granted may be cancelled at any time at the sole discretion of CITALID CYBERSÉCURITÉ. CITALID CYBERSÉCURITÉ reserves the right to request the removal of any link to the website that has not been authorized or is no longer authorized and to claim damages for any harm suffered in this regard. It is possible that web sites containing a hypertext link to the Site or one of its elements are not under the control of CITALID CYBERSÉCURITÉ, which consequently declines all responsibility (notably editorial) concerning access to these web sites and their content. The Site may contain links to other websites or external sources (“third-party websites”). Links to such other resources will cause you to leave the Site. Because CITALID CYBERSÉCURITÉ has no control over such third-party sites or their content, CITALID CYBERSÉCURITÉ makes no representations about the availability of such third-party sites or their content, and disclaims any responsibility for the content, advertising, products, services or other materials on or available from such third-party sites. Furthermore, these links do not indicate any association between CITALID CYBERSÉCURITÉ and the owners and/or authors, designers, managers, administrators of these third-party websites and declines all responsibility for their use, the User being solely responsible for activating these links.

Responsibility

The website and its content are provided “as is” and subject to availability. Users are solely responsible for their use of the website and its content. CITALID CYBERSÉCURITÉ does not warrant that the web site or its content will be error-free or accessible on an uninterrupted basis. Therefore, CITALID CYBERSÉCURITÉ cannot be held responsible for any inability to access the Site. Furthermore, CITALID CYBERSÉCURITÉ may interrupt the availability of the Site at any time without notice, in particular for technical and/or maintenance reasons, whatever the origin or cause. The User acknowledges and accepts that CITALID CYBERSÉCURITÉ is not responsible for such interruptions, and for the consequences that may result for the User or any third party. It is also specified that the Internet network and the information and telecommunication systems used to access and use the Site are not free from errors or bugs, and that interruptions and breakdowns may occur from time to time. CITALID CYBERSÉCURITÉ cannot be held responsible for any inconvenience, loss or damage related to the use of the Internet, including in particular in the event of transmission and/or reception of data and/or information on the Internet of poor quality, any defect in the reception of equipment or communication lines, any malfunction of the Internet network preventing the proper functioning of the site and, more generally, for any loss or damage resulting from the use of the site, the Internet network and information and telecommunication systems. CITALID CYBERSÉCURITÉ cannot be held responsible for any loss or damage, whatever the cause, resulting from the use of the website, for which the User is solely responsible.

Protection of personal data

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, and the General Regulation on the Protection of Personal Data (hereinafter “RGPD”) no. 2016/679/EU of April 27, 2016, CITALID CYBERSÉCURITÉ, in its capacity as data controller, guarantees respect for the privacy of Users of the Site. Applicable law and jurisdiction

These GCU and the content of the Site are governed by French law. The parties agree that any disputes arising out of or in connection with this agreement, which cannot be settled amicably, shall be submitted to the competent French courts.

Modification of Conditions of Use

The GCU are concluded for an indefinite period. The GCU are accessible and can be consulted at any time on the Site. CITALID CYBERSÉCURITÉ reserves the right to modify them at any time. The modified GCU come into force on the date of their posting on the Site and are deemed accepted without reservation by any User who browses the Site after their posting. The applicable GCU are those in force on the day of browsing the Site.
